Terms and Conditions

These Terms and Conditions (hereinafter referred to as the "Terms" or "Agreement") govern the legal relationship between this site (hereinafter referred to as the Site) represented by its owner (hereinafter referred to as the Administration) and a capable individual or legal entity (hereinafter referred to as the Users). This Agreement is a public contract (Article 633 of the Civil Code of Ukraine). Acceptance of the terms set forth in this Agreement is an automatic agreement with its implementation.

Terms and Definitions

  1. Site - this site, which is administered by the Administration.
  2. The site administration is its owner.
  3. User/Users - individuals and (or) legal entities browsing the Site.
  4. Personal data is information or a set of information about an individual who is identified or can be identified with their help.

General provisions

  1. The Agreement is considered concluded by the User without any reservations and exceptions at the time of any interaction of the User with the Site, while the User confirms his agreement with all the terms of the Agreement.
  2. The use of any function of the site by the User automatically means that the User accepts this Agreement.
  3. If the User does not agree with the Agreement in whole or in part, he must leave this site.
  4. The Administration has the right to change the text of this Agreement unilaterally. The new version of the Agreement comes into force from the moment it is posted on this website.
  5. Legal relations between the User and the Administration under this Agreement are governed by the legislation of Ukraine.

Disclaimer

  1. Administration is not responsible:
    • for malfunctions in the operation of the Site caused by interruptions in the operation of equipment and software, for failures that occur in telecommunications or energy networks, for failures caused by the actions of malicious programs or third parties;
    • for the content, reliability and legality of the information published on the Site;
    • for lost profits or damages caused to the User, for any other losses that may arise when using the Site and the information posted on it;
    • for any unauthorized access or use of the Site's servers and/or any user information stored on them, as well as for any bugs, viruses, Trojan horses, etc. that may be transmitted to or through the Site by third parties.
  2. The Administration does not participate in agreements between Users, therefore, does not bear any responsibility for these agreements.
  3. The User agrees to resolve all disputes with another User on his own and make claims to another User directly without involving the Administration in such disputes.
  4. The Administration has the right not to take any action on the complaint of the User.
  5. The Administration is not responsible for temporary failures in access to the Site due to circumstances beyond the control of the Administration.
  6. The Administration is not responsible for malfunctions in the operation of the Site caused by technical interruptions in the operation of equipment and software.
  7. The Administration is not responsible for direct and / or indirect losses, including lost profits, that the User may incur while using the Site, including due to improper fulfillment of their obligations by other users of the Site.

Processing of personal data

  1. The processing of personal data includes any actions or a set of actions related to the collection, registration, accumulation, storage, adaptation, modification, renewal, use, distribution, transfer, deletion of the User's personal data in order to ensure the operation of the Site's services.
  2. The processing by the Administration of the User's personal data is carried out in order to ensure the functioning of the Site and provide the User with personalized services of the Site. The Administration is not responsible for the use of the User's personal data by other persons.
  3. Other conditions for the use and (or) processing of the User's personal data are set out in the Privacy Policy.

The administration has the right:

  1. set restrictions on the use of the Site services;
  2. change or terminate the operation of the site services in whole or in part with or without notice to the User;
  3. deny the User access to the Site;
  4. remove or move any information posted on the Site;
  5. transfer the Site with all its services and content, including personal information of Users, to its successor and (or) another person under contracts or for other reasons.

The term of the Agreement and termination of the provision of services to the Site

  1. This Agreement comes into force from the moment the User accepts the terms of this Agreement and is valid indefinitely.
  2. If the User does not agree with any changes to this Agreement or other terms or conditions of use of the Site, the User is obliged to immediately stop any use of the Site and leave the Site.
  3. Continued use of the site is an automatic confirmation of the User's consent to the changes made to the Agreement or other conditions or rules.

Final provisions

  1. The Agreement or any part of it can be changed by the Administration without any special notification from the User. The new version of the Agreement comes into effect from the moment it is posted on the Site. The current version of the Agreement is always available at this address.
  2. In case of disputes / disagreements between the parties, they will be resolved through negotiations. If it is impossible to resolve the dispute through negotiations, the dispute is subject to settlement in the manner prescribed by applicable law.
  3. In cases unforeseen by this Agreement, the parties are guided by the current legislation of Ukraine.
